Terms of Service

By accessing or using any product or service provided by Orbyx ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all Orbyx products including NightShift, MintScan, BidWin, QuickQuote, OSHA-Snap, and any future products operated under the Orbyx brand.

Orbyx provides AI-powered SaaS tools for specific industries. Our products use large language models, computer vision, and third-party APIs to automate tasks including call handling, document generation, image analysis, and job quoting. All AI outputs are provided for informational and operational assistance purposes only and do not constitute professional legal, financial, safety, or medical advice.

You must create an account to use most Orbyx products. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these terms or that are used for unauthorised purposes.

You agree not to use our services to:

• Violate any applicable law or regulation
• Submit false, misleading, or fraudulent information
• Attempt to reverse-engineer, scrape, or extract our AI models or infrastructure
• Resell or sub-license access to our services without written permission
• Use automated systems to access our services in ways that exceed normal usage

Our products use AI to generate content including bid proposals, safety reports, card grades, and job quotes. These outputs are computer-generated and may contain errors or omissions. You are solely responsible for reviewing, verifying, and acting on any AI-generated content. Orbyx does not guarantee the accuracy, completeness, or fitness of any AI output for any particular purpose.

All software, designs, trademarks, and content on Orbyx platforms are owned by Orbyx or its licensors. You retain ownership of any data or content you submit. By using our services, you grant Orbyx a limited, non-exclusive licence to process your submissions for the purpose of delivering the service. We do not use your submitted content to train AI models without your explicit consent.

Paid plans are billed in advance on a monthly or annual basis. All prices are in AUD unless stated otherwise. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are provided at our discretion and are generally not issued for partial billing periods. We reserve the right to change pricing with 30 days notice.

To the maximum extent permitted by law, Orbyx's total liability for any claim arising from these terms or our services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss.

Our services are provided "as is" without warranties of any kind. We do not warrant that our services will be uninterrupted, error-free, or free from harmful components. We disclaim all implied warranties including merchantability and fitness for a particular purpose to the fullest extent permitted by Australian law.

You may stop using our services at any time by cancelling your subscription and deleting your account. We may terminate or suspend your access immediately if you breach these terms, without prior notice or liability.

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, and you consent to the exclusive jurisdiction of those courts.

We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on our platform. Continued use after changes take effect constitutes acceptance of the new terms.
